Welcome — these Terms & Conditions (“Terms”) explain the rules for using the website and services offered by Ben Eden — The Healing Medium (the “Site”, “we”, “us”, or “our”), accessible at www.beneden.com.au. By accessing the Site, booking sessions, enrolling in programs, or otherwise using our Services you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site or our Services.

Ben Eden operates the Site and delivers coaching, spiritual guidance, mediumship training, online courses, live workshops, community membership, and related services (collectively, the “Services”).

2. Acceptance & eligibility
You must be at least 18 years old (or have legal capacity) to use or purchase Services. By using the Site or purchasing Services you confirm you are legally able to enter a binding agreement.
3. Booking, registration & accounts
Some Services (bookings, courses, memberships) require account registration. You agree to provide accurate and complete information and to keep login credentials secure.
You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. Services & changes
We provide coaching, mediumship training, workshops, digital products, and community services as described on the Site.
We may modify, suspend, or discontinue any Service or content at any time, with or without notice. If a program is substantially changed, we will notify affected participants and offer a remedy where appropriate.
5. Payments, billing & taxes
Prices are displayed in AUD unless stated otherwise. Payment is due at the time of purchase.
Payments are processed by third-party payment providers; we do not store full card numbers on our servers.
You are responsible for any applicable taxes unless stated otherwise.
If a payment fails, we may suspend access to paid content until payment is resolved.
6. Refunds & cancellation policy (standard)
These are our standard policies; specific programs may have different, published terms at purchase:
One-to-one sessions / Consultations
Free reschedule or full refund if cancelled more than 48 hours before the appointment.
Cancellations within 48 hours may be non-refundable or subject to a cancellation fee.
Live workshops & group programs
Refunds are available if you cancel within 14 days of purchase and before access to course materials or live sessions has been used; after that partial or no refunds may apply. Check the program page for exceptions.
Digital downloads & on-demand courses
Digital products are non-refundable once downloaded or access has been granted. If you experience a technical problem, contact support and we will assist.
If you believe a refund is warranted, contact [email protected]. We may update these policies for specific programs; always review the refund/cancellation terms shown at checkout.
7. Your conduct & obligations
When using the Site and Services you agree not to:
Use the Services for unlawful purposes or in a way that harms others.
Harass, abuse, defame, or threaten other participants or staff.
Share another person’s confidential information without consent.
Circumvent access controls, copy or redistribute content in violation of these Terms.
We may suspend or terminate access for misconduct.
8. Intellectual property
All content on the Site (text, images, video, course materials, recordings, logos, and trademarks) is owned or licensed by Ben Eden. You are granted a limited, non-exclusive, non-transferable license to access and use purchased materials for personal or organisational use as permitted at purchase. You must not copy, redistribute, resell, or publish materials without written permission.
9. User content, testimonials & community posts
By submitting content (testimonials, comments, forum posts), you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and publish that content for promotion or any lawful purpose.
If you want a published testimonial removed, contact us and we will take reasonable steps to address your request.
10. Medical, legal & other professional disclaimers
The Services are educational, spiritual, and coaching in nature. They do not replace professional medical, legal, financial, or psychological advice. If you have health, legal, or financial concerns, consult a qualified professional. You accept responsibility for your own decisions and outcomes.
11. SMS, messaging, and A2P compliance (important)
We use SMS and automated messaging for transactional and, with consent, marketing communications. By providing a phone number you explicitly consent to receiving messages from Ben Eden as described below and in our Privacy Policy.
Transactional/Service messages: appointment confirmations, reminders, account notices, program access notifications. These are usually required to deliver Services.
Marketing messages: program announcements, offers, and updates — only sent if you opt in.
All messages include clear opt-out instructions (reply STOP to unsubscribe) and help instructions (reply HELP). Standard message/data rates may apply.
We comply with applicable Australian laws (including the Spam Act) and carrier/A2P requirements. We maintain opt-in records (timestamp, source, IP) to demonstrate consent for regulatory or carrier queries and to support A2P approvals. We use trusted third-party messaging providers for delivery; these providers have their own compliance checks.
Suggested opt-in wording (use on forms):
“By checking this box I consent to receive SMS messages from Ben Eden (Ben Eden — The Healing Medium) at the phone number I provide. Messages may include appointment reminders, program updates, and occasional offers. Reply HELP for help or STOP to unsubscribe. Msg & data rates may apply.”
12. Third-party services & integrations
We may integrate with third-party platforms (payment processors, email/SMS providers, video hosts). Your use of those services may be subject to additional terms of those providers. We are not responsible for third-party practices.
13. Limitation of liability
To the maximum extent permitted by law, our liability to you for any claim arising from these Terms or Services is limited to the total amount paid by you to us in the six (6) months preceding the claim. We are not liable for indirect, incidental, special, or consequential losses (including lost profits, data loss, or business interruption). This limitation does not exclude liability for death or personal injury caused by our negligence, or other liability which cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold harmless Ben Eden and its officers, employees and agents from any claims, liabilities, losses or expenses (including legal fees) arising from your breach of these Terms, your negligence, or your violation of any law.
15. Termination & suspension
We may suspend or terminate your access to the Site or Services at our discretion for violation of these Terms, unlawful conduct, or where required by law. On termination, your right to access paid content ends; accrued payment obligations remain.
16. Refunds & chargebacks (administrative)
If you dispute a charge with your bank (chargeback) without contacting us first, we reserve the right to suspend service until the dispute is resolved and may deduct administrative costs if the chargeback is found to be invalid. Please contact [email protected] first for assistance.
17. Dispute resolution & governing law
These Terms are governed by the laws of the State of Queensland, Australia. If a dispute arises, we ask that you first contact us so we can try to resolve it informally. If not resolved, the dispute may be referred to the courts in the State of Queensland.
18. Changes to these Terms
We may revise these Terms from time to time. Changes will be posted on this page with a new “Last updated” date. Continued use after changes are posted constitutes acceptance of the revised Terms.
19. Severability & entire agreement
If any part of these Terms is found unenforceable, the remainder will continue in full force. These Terms, together with our Privacy Policy and any program-specific terms displayed at purchase, constitute the entire agreement between you and us regarding the Services.
